This policy sets out to explain the policies of Fynepicks E-Retail Private Limited, referred to as “The Firm”, “We”, “Us”, Our” in this agreement for the collection, usage, storage, sharing, security, access and control of the information shared by the User, referred to as “You”, “Your” which includes any person/ persons, buyer, guest user and seller who visits, uses, interacts and/ or performs financial transactions through the Website, also referred to as “Site”, which means the website and its tools at www.fynepicks.com. This Policy is a binding legal contract between any user of the website and the Firm.
In this policy,
“Seller” refers to any Individual/ Brand/ Sole-proprietorship/ Partnership/ LLB firm using our Website to sell their products
“User dashboard” refers to the set of tools made available to the user to view, shop, store information, addresses, and perform financial transactions on the website
“Seller dashboard” refers to the set of tools made available to the seller to list, edit, manage and view products for sale
“Tools” collectively refers to the user dashboard, seller dashboard and gift finder
“Services” collectively refers to support services, marketplace services and other services offered on our website either by us or through a third-party application or software
“Personal information”/ “Information” refers to any data, information, or combination of data and information that is provided by the user to us, or through the use of our products or services, that relates to an identifiable individual
1.1. By using our Website and its services, the user consents to his personal information being used for the specific purposes. The following information is collected when the user provides it to us or when the user visits or uses our website and its services.
(b) content the user provides through the use of our website and its tools. For sellers, this also includes the bank account details, PAN card details, tax registration details, company details provided to us via email, SMS, or any online or offline communication channels. (collectively, “User Content”);
(c) information provided by the user to interact with our support team to report any issues related to the products listed or an order fulfilled through us, including but not limited to any contact information, documentation, or screenshots (collectively, “Support Data”);
(d) details of any transactions, purchases, or orders made with us (collectively, “Transaction Data”);
(e) payment information (collectively, “Financial Data”);
(f) information about the user’s device or connection, including but not limited to IP, cookies and (please read our Cookies Policy for details) (collectively, “Technical Data”); and
(g) Information about the user’s visit to our Website, including but not limited to the products viewed, searched for, page response times, download errors, length of visits to the Website and individual pages on the Website,scrolling, clicks, and mouse-overs, or methods to browse away from the page” (collectively, “Usage Data”).
1.2. We may also receive information about the user from other sources, such as the information shared with us by the third party applications on the website according to their Privacy policies.
1.3. We do not collect sensitive data or special category data about the user unless it is made available to us through social media logins. This includes details about the user’s race, ethnic origin, politics, religion, trade union membership, genetics, biometrics, health, or sexual orientation.

2.Use of information collected

(b) we need to carry out functions related to an order placed on the website
(c) we need to analyse, prevent, mitigate and investigate fraudulent or illegal activities on the website
(d) we need to provide customer support related to an order placed or in general

(f) we need to perform the contract we have entered into (or are about to enter into) with you

2.2. Information that is not required for performing activities on the website unhindered, fulfilling an order or resolving disputes regarding orders is classified as unsolicited information. Any such information shared with us by the user through the website, E-mail, SMS, or via any online or offline communication channels shall be deemed to be non-confidential and shall be used without any limitations.
3. Sharing of information collected
3.1. We do not disclose any sensitive personal data, such as bank account details and E-mail, to the sellers registered on the website.
3.2. We may share personal information on an aggregated or de-identified basis with third parties for research and analysis, profiling, and similar purposes to help us improve our products and services.
3.2. Our Website may contain links to third-party websites over which we have no control over. If you follow a link to any of these websites or submit information to them, your information will be governed by their policies. We assume no liability for any damages caused to the user due to sharing personal information with third-parties. 3.4. We assume no liability for any breach of security or disclosure of personal information due to unauthorised third-party access or other actions by third parties that are beyond our control unless such breach has been caused due to our gross negligence or wilful default
3.5. We shall not be liable for any personal damages to the user due to phishing scams. We do not send out emails requesting any sensitive information from the user.
3.6. We may share the user’s personal information with government and law enforcement officials to comply with applicable laws or regulations
3.7. If we are acquired by a third party as a result of a merger, acquisition, business reorganization or bankruptcy, your personal information may be disclosed and/or transferred to a third party in connection with such transaction. We will notify you if such transaction takes place and inform you of any choices you may have regarding your information.

4.1. We use data hosting service providers based in India to host the information we collect.
4.2. We have adopted the following measures to protect the security and integrity of your personal information:

4.5. After such time, we will delete or anonymise your information, or if this is not possible, we will securely store your information and isolate it from further use. We periodically review the basis and appropriateness of our data retention policy.
4.6. We shall not liable for any data breach or disclosure of personal information if it results from a Force Majeure Event For purposes of this Contract, a “Force Majeure Event” is an event which is a circumstance or event beyond the reasonable control of the Party which frustrates the performance of the Party’s obligations under this Contract. Such circumstance or event shall include but not limited to acts of God, fire, flood, lightning, war, revolution, acts of terrorism, riots, strikes, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption and other industrial actions and failures of supplies of power.
5. Changes to this policy
5.1. We may amend this policy from time to time by posting the updated policy on our Website. By continuing to use our Website after the changes come into effect, you agree to be bound by the revised policy.
6. Policy towards children
6.1. Our products and services are not directed to individuals under 18. We do not knowingly collect personal information from individuals under 18. If we become aware that an individual under 18 has provided us with personal information, we will take steps to delete such information. Contact us if you believe that we have mistakenly or unintentionally collected information from an individual under 18.
